Purpose
These Terms of Service ("Terms") govern access to and use of Stampioo, a digital loyalty card platform for Apple Wallet and Google Wallet.
The service is provided by Allvia AB ("Stampioo", "we", "us", or "our").
By registering an account, using the platform, or subscribing to the service, you agree to be bound by these Terms in their entirety.
If you use Stampioo on behalf of a business or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.
Definitions
Stampioo: The platform, website, dashboard, applications, APIs, and related services.
Business User: An individual or legal entity that registers an account to create and manage loyalty programmes.
Employee: A person invited by a Business User to access and use Stampioo.
End Customer: A person who has added a digital loyalty card to Apple Wallet or Google Wallet.
Loyalty Card: A digital card created through Stampioo and distributed to End Customers.
Subscription: A paid plan that provides access to features and functionality on the platform.
Access to the Platform
3.1 Business Users
To use Stampioo, you must:
- Be at least 18 years of age
- Provide accurate and up-to-date information
- Keep your account information current
- Protect your login credentials
You are responsible for all activities conducted through your account.
3.2 Employees
Business Users may grant additional individuals access to the platform.
Each user must have their own account and may not share login credentials with others.
3.3 End Customers
End Customers are generally not required to create an account with Stampioo.
Access to the service is provided through the addition of a digital loyalty card to Apple Wallet or Google Wallet.
Description of the Service
Stampioo enables businesses to:
- Create digital loyalty cards
- Customize card designs and rewards
- Distribute cards through Apple Wallet and Google Wallet
- Register stamps and rewards
- Track loyalty programme activity
- Collect customer information submitted when joining a loyalty programme
- Send notifications to card holders
- Communicate with specific customer segments
- Export customer data where this feature is available under the selected subscription plan
Stampioo reserves the right to develop, modify, or remove features from the platform at any time.
Subscriptions and Payments
5.1 Free Trial Period
Stampioo may offer free trial periods to new Business Users.
The duration of any trial period will be specified at the time of registration.
After the trial period ends, certain features may become restricted until a paid subscription is activated.
5.2 Paid Subscriptions
Current subscription plans, features, and pricing are available on the Stampioo website or payment page.
Features may vary between subscription tiers.
5.3 Payments
Payments are processed through Stripe or another payment provider selected by Stampioo.
Subscriptions automatically renew until cancelled.
By providing a payment method, you authorize Stampioo to automatically charge future subscription fees in accordance with your selected subscription plan.
5.4 Pricing Changes
Allvia AB reserves the right to modify subscription pricing and subscription terms.
Material pricing changes will be communicated in advance via email or through notices displayed within the platform.
Termination
6.1 Subscription Cancellation
Business Users may cancel their subscription at any time through the platform.
Cancellation becomes effective at the end of the current billing period.
6.2 Termination by Us
Allvia AB may suspend or terminate accounts for:
- Violation of these Terms
- Fraudulent or unlawful activity
- Non-payment of fees
- Abuse of the platform
- Conduct that threatens the security or stability of the service
In cases of serious violations, suspension may occur immediately.
6.3 Effects of Termination
Upon termination of a subscription:
- Access to the platform will cease
- Customer data will be retained for a limited period in accordance with the Privacy Policy
- Installed loyalty cards may remain in a user's Wallet but will no longer receive updates
Intellectual Property Rights
7.1 Stampioo's Rights
Stampioo, including its software, design, functionality, user interface, documentation, trademarks, and other content, is owned by Allvia AB or its licensors.
A subscription grants only a limited, non-exclusive, non-transferable right to use the service during the subscription period.
No part of Stampioo may be:
- Copied
- Resold
- Sublicensed
- Decompiled
- Reverse engineered
- Used to develop a competing service
without the prior written consent of Allvia AB.
7.2 Business User Content
The Business User retains ownership of all content uploaded to the platform, including but not limited to:
- Logos
- Images
- Business names
- Descriptions
- Promotional materials
By uploading such content, the Business User grants Allvia AB the right to use, process, reproduce, and display the content to the extent necessary to provide and operate the service.
7.3 Reference Customers
Unless otherwise agreed, Allvia AB may display the Business User's company name, logo, and examples of loyalty cards as reference material on the Stampioo website, in sales materials, or in marketing communications.
The Business User may request that such use be discontinued at any time by contacting support@stampioo.com.
Customer Data and Data Protection
8.1 GDPR Roles
The Business User acts as the Data Controller for personal data collected from its customers.
Allvia AB acts as a Data Processor and processes such data solely for the purpose of providing Stampioo's services.
8.2 Ownership of Customer Data
The Business User retains ownership of its customer data.
Allvia AB does not claim ownership of such information and does not use it for its own marketing purposes.
8.3 Data Separation
Customer data is kept separate between different businesses using the platform.
Allvia AB does not match, merge, combine, or cross-reference customer data between different businesses using Stampioo.
8.4 Personal Data Incidents
If Allvia AB becomes aware of a confirmed personal data breach affecting a Business User's customer data, the Business User will be notified without undue delay.
8.5 End Customer Information
A name is required when an End Customer joins a loyalty programme through Stampioo.
When creating a loyalty programme, the Business User may choose whether to ask End Customers for additional information such as email address, telephone number, and birthday or date of birth.
The Business User is responsible for ensuring that it has a valid legal basis for collecting and using any additional customer information, and for providing any information to End Customers that may be required under applicable data protection laws.
8.6 Marketing Consent and Customer Export
Where the Business User enables marketing consent, Stampioo may record whether an End Customer has agreed to receive offers, promotions, and updates from that Business User.
The Business User is solely responsible for using customer data, including exported customer data, in accordance with each customer's marketing consent status and applicable laws.
Customer data exported from Stampioo may only be used for the Business User's own lawful business purposes and may not be sold, shared with other businesses, or used to market products or services on behalf of another business.
User Responsibilities
9.1 Business User Responsibilities
Business Users are responsible for:
- Complying with all applicable laws and regulations
- Using the platform only for lawful purposes
- Protecting their login credentials
- Ensuring that uploaded content does not infringe the rights of any third party
- Ensuring that they have the necessary rights and permissions to use any customer data processed through the service
9.2 Employee Responsibilities
Employees are responsible for:
- Using the service only within the scope of their assigned duties
- Not sharing login credentials with others
- Treating customer data as confidential
Prohibited Use
Users may not:
- Use Stampioo for unlawful activities
- Distribute malicious software, malware, or viruses
- Attempt to bypass or circumvent security features
- Attempt to gain unauthorized access to other accounts
- Use the service in a manner that negatively impacts other users
- Use the service for spam or mass communications that violate applicable laws
- Use the service to develop, build, or improve a competing product or service
Allvia AB reserves the right to suspend or terminate accounts that violate these provisions.
Notifications and Promotional Campaigns
Stampioo provides functionality that enables businesses to communicate with their own loyalty programme customers, including through Wallet notifications and available customer communication or export features.
The Business User is solely responsible for:
- Having the legal right to communicate with recipients
- Complying with applicable marketing, advertising, electronic communications, and data protection laws
- Respecting each customer's marketing consent status and communication preferences
- Ensuring that exported customer data is used only for lawful purposes
- Ensuring that customers who have not agreed to marketing are not contacted for marketing purposes unless another valid legal basis exists
The following activities are prohibited:
- Sending third-party advertisements
- Selling, renting, or sharing customer data with other businesses
- Using Stampioo as a general-purpose mass messaging or spam tool
- Sending misleading, deceptive, or fraudulent communications
- Marketing products or services on behalf of another business
- Contacting customers in violation of their marketing consent status or applicable law
Violation of these rules may result in the immediate suspension or termination of the account.
Availability and Maintenance
Allvia AB strives to maintain a high level of availability for Stampioo but does not guarantee uninterrupted operation of the service.
The service may be temporarily unavailable due to:
- Scheduled maintenance
- Security updates
- Technical failures
- Issues affecting third-party providers
- Events beyond our reasonable control
Allvia AB shall not be liable for losses arising from temporary interruptions of the service.
Disclaimer of Warranties
Stampioo is provided on an "as is" and "as available" basis.
Allvia AB makes no express or implied warranties regarding:
- Continuous availability of the service
- The absence of errors, interruptions, or defects
- Suitability of the service for any particular purpose
- Compatibility with all devices, operating systems, or third-party services
Use of the service is at the user's own risk.
Limitation of Liability
To the maximum extent permitted by applicable law, Allvia AB shall not be liable for:
- Indirect damages
- Loss of revenue
- Loss of profits
- Loss of business opportunities
- Loss of goodwill
- Loss of data
- Operational downtime experienced by the user
Allvia AB shall not be liable for:
- Content published by users
- Relationships between Business Users and their customers
- Incorrect promotions or offers created by users
- Decisions made based on statistics, reports, or analytics provided through the platform
- Issues arising from Apple Wallet, Google Wallet, Stripe, Microsoft, Mapbox, or other third-party providers
The total liability of Allvia AB under these Terms shall never exceed the amount paid by the Business User to Allvia AB during the twelve (12) months preceding the event giving rise to the claim.
Indemnification
The Business User agrees to indemnify, defend, and hold harmless Allvia AB from and against any claims, costs, losses, damages, liabilities, and expenses arising out of or related to:
- The Business User's use of the service
- Content uploaded to the platform
- Violations of these Terms
- Violations of applicable laws or regulations
- Third-party claims relating to the Business User's loyalty programme
Force Majeure
Allvia AB shall not be liable for any delay or failure to perform its obligations where such delay or failure results from circumstances beyond its reasonable control.
Examples include:
- Natural disasters
- War, civil unrest, or government actions
- Strikes or labor disputes
- Cyberattacks
- Failures of internet or cloud service providers
- Failures of third-party service providers
Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of Sweden.
The parties shall first attempt to resolve any dispute through good-faith discussions and negotiations.
If a dispute cannot be resolved amicably, it shall be submitted to the competent courts of Sweden.
Nothing in these Terms shall limit any mandatory consumer rights granted under applicable law.
Changes to the Terms
Allvia AB reserves the right to update or modify these Terms of Service at any time.
Where material changes are made, users will be notified through email, notices within the platform, or other appropriate means.
The latest version of these Terms will always be available on the Stampioo website.
Continued use of the service after such changes become effective constitutes acceptance of the updated Terms.
Miscellaneous
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
Any failure by Allvia AB to enforce a right or provision under these Terms shall not constitute a waiver of that right or provision.
These Terms constitute the entire agreement between the parties regarding the use of Stampioo and supersede all prior agreements, understandings, and communications relating to the same subject matter.
